Terms of Use
Effective date: May 16, 2026. These terms are a comprehensive launch template customized for Baby Cam. Replace operator details and governing-law choices with the final legal entity before publication.
1. Acceptance of these terms
By downloading, installing, accessing or using Baby Cam, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the app, website, web viewer, server, admin tools or related services.
If you use Baby Cam on behalf of a family, household, organization or other person, you confirm that you have authority to do so and that you are responsible for their use.
2. The service
Baby Cam provides software for camera streaming, viewer access, sound and motion indicators, alerts, two-way talk, local history, snapshots, recordings, lullabies, night light, baby tracker features, local network viewing, cloud routing, direct mode where supported, web viewing, watch support and custom server options.
Features may vary by platform, device model, operating system version, subscription status, permissions, network configuration, app store rules and server availability.
3. Not a safety-certified baby monitor
Baby Cam is not a medical device, life-safety system, emergency alert system, certified baby monitor, security alarm or substitute for adult supervision.
You must not rely on Baby Cam as the only way to supervise a baby, child, vulnerable person, pet, property or emergency situation. Streams, alerts and notifications can be delayed, missed, muted, blocked or unavailable.
4. Your responsibilities
- Place devices safely and keep cables, chargers and accessories away from children.
- Keep camera and viewer devices charged, cooled, updated and connected to reliable networks.
- Check the app, audio, video, alerts, volume, Do Not Disturb settings and notification permissions before relying on a session.
- Protect QR codes, pairing codes, trusted-device approvals, subscription-sharing codes and admin credentials.
- Approve only viewers you trust and remove trusted devices you no longer use.
- Use custom servers, local network and direct mode only if you understand the privacy and security consequences.
- Comply with all applicable laws about recording audio/video, monitoring, privacy, consent, child data, employment, tenants, visitors and household members.
5. Accounts, devices, pairing and access
Baby Cam may identify devices using app-generated IDs, platform information, subscription status, pairing codes and trusted-viewer records. Pairing a viewer gives that viewer access to the selected stream until access is removed, expired or technically interrupted.
You are responsible for all activity from devices you pair or approve. We may block devices, streams, subscriptions or IP addresses to protect the service or users.
6. Free version, ads and subscriptions
- The free version may include ads, feature limits, history limits, frame-rate limits or other restrictions.
- Premium subscriptions may remove ads and unlock higher frame rates, additional history, sharing, preferred servers or other features described in the app or app store listing.
- Subscription sharing may be limited, for example to a maximum of two phones and two desktop devices per subscription unless the app states otherwise.
- Subscriptions purchased on Android or iOS are billed by the relevant app store and renew automatically unless cancelled through that store.
- Refunds, billing disputes, taxes and cancellation timing are generally handled under Apple, Google or the applicable store/payment provider rules.
- Prices, features, trials and limits may change prospectively. We will not materially reduce paid features during an active paid period without a reasonable basis or notice where required.
7. License to use Baby Cam
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use Baby Cam for personal, household baby monitoring and related caregiver use.
You do not receive ownership of the app, website, server code, designs, trademarks, logos, text, icons, templates or other intellectual property.
8. Acceptable use
- Do not use Baby Cam to monitor people without any consent required by law.
- Do not access, guess, brute force, enumerate, scrape or interfere with streams, stream IDs, pairing codes, devices, APIs, servers or admin tools.
- Do not reverse engineer, modify, resell, rent, sublicense, bypass limits, remove ads without authorization, or create a competing service using Baby Cam components unless expressly permitted by an open-source license that applies to a specific component.
- Do not upload, transmit, record, export or share illegal, abusive, harmful, exploitative, infringing or privacy-invasive content.
- Do not use Baby Cam for professional surveillance, healthcare, law enforcement, workplace monitoring, childcare center compliance, or other regulated uses unless you independently ensure legal compliance.
- Do not overload servers, perform security testing without permission, or use automated tools to test stream codes or endpoints.
9. User content, snapshots, recordings and exports
You keep ownership of content you create or store locally, including snapshots, recordings, tracker notes, child profiles, lullabies you import, and exports. You grant us only the limited rights needed to process content when you choose features that require processing.
You are responsible for obtaining rights and consents for any media you import, play, capture, record, export or share. We are not responsible for what you do with local files or third-party sharing tools.
10. Custom servers, local network, direct mode and third-party services
Baby Cam may support local network viewing, direct mode, casting, web viewing, custom compatible stream servers, YouTube playback, app stores, ads, payment providers, operating system services and other third-party services.
Third-party and self-hosted systems are not controlled by Baby Cam. Their availability, security, privacy, compatibility and legality are your responsibility. SSL/TLS is strongly recommended for any public custom server.
11. App stores and platform terms
Your use of Baby Cam may also be governed by Apple App Store, Google Play, Microsoft Store or other platform terms. If app-store terms conflict with these terms about payment, refunds, cancellation or platform functionality, the app-store terms may control for that platform transaction.
12. Updates, beta features and changes
We may add, change, suspend or remove features, connection modes, server locations, subscription benefits, UI flows, device support or compatibility. Beta, debug, developer, custom server, smartwatch, direct connection and experimental features may be unstable or incomplete.
You are responsible for installing updates needed for security, compatibility and reliability.
13. Availability and service interruptions
Baby Cam may be unavailable, delayed or degraded because of device limitations, low battery, overheating, permissions, operating system restrictions, network issues, Wi-Fi sleep behavior, firewalls, VPNs, Bluetooth limitations, browser autoplay rules, app bugs, cloud outages, maintenance, abuse prevention, rate limits, app-store actions or events outside our control.
We do not guarantee continuous, secure, real-time, error-free, low-latency or universally compatible operation.
14. Disclaimers
To the maximum extent permitted by law, Baby Cam is provided as is and as available, without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, security, suitability for baby safety, or compatibility with every device, network or platform.
Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.
15. Limitation of liability
To the maximum extent permitted by law, Baby Cam and its operators, developers, affiliates, suppliers and service providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of data, missed alerts, failed streams, inability to access a baby monitor session, device damage, emotional distress, childcare decisions, personal injury, or damages caused by network/server/device failure.
Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid for Baby Cam in the 12 months before the claim or EUR 50, unless applicable law requires a higher amount.
16. Indemnity
Where permitted by law, you agree to defend, indemnify and hold harmless Baby Cam and its operators from claims, damages, losses, liabilities and expenses arising from your misuse of the service, violation of these terms, unlawful monitoring/recording, custom server operation, shared content, or infringement of third-party rights.
17. Suspension and termination
We may suspend or terminate access to cloud services, admin tools, subscriptions, stream servers or accounts if we reasonably believe there is abuse, security risk, illegal activity, non-payment, policy violation, harmful behavior, or operational risk.
You may stop using Baby Cam at any time and delete local data using the app or operating system tools. Subscription cancellation must be completed through the relevant app store if purchased there.
18. Privacy
The Privacy Policy explains how information is processed. By using Baby Cam, you acknowledge that live streaming, pairing, routing, subscriptions, ads, local data and support workflows involve data processing as described there.
19. Governing law and disputes
Before launch, replace this section with the governing law, venue, consumer-law language, arbitration/class-action terms if used, and mandatory local rights for the operator's jurisdiction. Nothing in these terms limits non-waivable consumer rights.
20. Changes to these terms
We may update these terms when features, laws, providers or business operations change. Material changes should be posted on the website or in the app. Continued use after the effective date means you accept the updated terms, where permitted by law.
